Terms of Service

These Terms of Service ("Terms") govern your access to and use of FitSnap's website, Chrome extension, and services (collectively, the "Service"). By accessing or using FitSnap, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
1. Acceptance of Terms
By creating an account, using the Service, or accessing any part of FitSnap, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
2. Eligibility
You must be at least 13 years old (or 16 in the EU) to use FitSnap. By using the Service, you represent and warrant that you meet the age requirement and have the legal capacity to enter into these Terms. If you are under 18, you must have parental or guardian consent.
3. Account Registration and Security
To use certain features of FitSnap, you must create an account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain and update your account information as necessary
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized access or security breach
- Accept responsibility for all activities that occur under your account
We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent or harmful activity.
4. FitPoints Credit System
4.1 Free Plan
Free users receive 100 FitPoints per month, automatically reset on their signup anniversary day each month. FitPoints do not roll over to the next month and unused credits expire at reset.
4.2 Pro Plans
Pro plans offer higher FitPoint allocations (1K, 2.5K, 5K, or 7.5K per month) via paid subscription. Credits reset to the plan limit on your subscription renewal date. When upgrading from Free to Pro, your credits are replaced (not added) with the plan's credit amount.
4.3 Usage
Each outfit generation costs 10 FitPoints. Credits are deducted immediately upon successful generation. If you do not have sufficient credits, generation will not proceed. Credits cannot be transferred, sold, or refunded except as required by law or as specified in our refund policy.
5. Subscriptions and Billing
5.1 Subscription Plans
Pro subscriptions are billed monthly through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel. Subscription fees are charged in advance for each billing period.
5.2 Cancellation
You may cancel your subscription at any time through your account settings or the Stripe Customer Portal. Cancellation takes effect at the end of your current billing period. You will retain access to Pro features and FitPoints until the period ends. No partial refunds are provided for unused portions of a billing period.
5.3 Price Changes
We reserve the right to modify subscription prices. We will notify you of any price changes at least 30 days in advance. Continued use of the Service after the price change becomes effective constitutes acceptance of the new pricing.
5.4 Refunds
Refunds may be provided for accidental charges or trial conversions within 7 days of the charge date, subject to review. Refund requests must be submitted to tzepchris@gmail.com. Refunds are not available for used FitPoints or after the refund window expires, except where required by applicable law.
6. Acceptable Use
You agree not to:
- Use the Service for any illegal purpose or in violation of any laws
- Upload, generate, or share content that is harmful, offensive, defamatory, or violates others' rights
- Attempt to reverse engineer, decompile, or extract the source code of the Service
- Use automated systems (bots, scrapers) to access the Service without authorization
- Interfere with or disrupt the Service, servers, or networks
- Impersonate others or provide false information
- Share your account credentials or allow others to use your account
- Use the Service to generate content that infringes intellectual property rights
- Upload malicious code, viruses, or harmful software
Violation of these rules may result in immediate termination of your account and legal action.
7. AI-Generated Content Disclaimers
FitSnap uses third-party AI services to process outfit generation requests. When you request an AI-generated outfit preview, your reference photo and product information are transmitted to third-party AI service providers' servers for processing. By using FitSnap's AI features, you acknowledge and agree that:
- Third-Party Processing: Your images and product information will be processed by third-party AI services and are subject to those services' terms of service and privacy policies. We do not control third-party AI service providers' data processing practices, retention policies, or security measures.
- Accuracy: AI-generated images are approximations and may not perfectly represent how an outfit will look in reality. Results may vary based on photo quality, lighting, and other factors.
- No Guarantee: We do not guarantee that generated images accurately reflect fit, color, texture, or appearance of actual products. AI-generated outputs may contain errors, artifacts, or unexpected results, and we do not guarantee accuracy or quality.
- Your Responsibility: You are responsible for reviewing all AI-generated outputs before making any purchasing decisions. FitSnap is not liable for any dissatisfaction with purchases made after viewing generated images.
- Use at Your Own Risk: You are solely responsible for decisions made based on AI-generated content.
- No Endorsement: Generated images do not constitute endorsement of any product, brand, or retailer.
8. Intellectual Property
8.1 Our Rights
FitSnap and its original content, features, and functionality are owned by Tzepeloglou Christos and are protected by international copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.
8.2 Your Content
You retain ownership of reference photos and other content you upload. By using the Service, you grant us a limited, non-exclusive license to use, store, and process your content solely to provide the Service (e.g., generating outfit previews). You represent that you have the right to grant this license and that your content does not infringe others' rights.
8.3 Generated Images
Generated outfit images are created using AI and may incorporate elements from your reference photos and product images. You may use generated images for personal, non-commercial purposes. Commercial use may require additional permissions or licenses.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FITSNAP AND ITS OPERATOR (TZEPELOGLOU CHRISTOS) SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100 USD, WHICHEVER IS GREATER.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you.
10. Warranty Disclaimer
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
11. Termination
We may suspend or terminate your account and access to the Service at any time, with or without cause or notice, for any reason including violation of these Terms. Upon termination:
- Your right to use the Service immediately ceases
- All FitPoints and subscription benefits are forfeited
- We may delete your account data and uploaded content
- Provisions that by their nature should survive termination (e.g., intellectual property, limitation of liability) will remain in effect
You may terminate your account at any time by deleting it through your account settings or contacting us.
12. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of Greece, without regard to its conflict of law provisions.
Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Thessaloniki, Greece. You agree to submit to the personal jurisdiction of such courts.
If you are a consumer in the EU, you may also have the right to bring disputes before the courts of your country of residence, and certain consumer protection laws may apply.
13. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Effective Date." Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms. If you do not agree to the changes, you must stop using the Service and may terminate your account.
14. Miscellaneous
14.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and FitSnap regarding the Service and supersede all prior agreements.
14.2 Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
14.3 Waiver
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
14.4 Assignment
You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms without restriction.
